1. Scope
This Acceptable Use & Data License (“License”) is part of the Terms of Service between you and UncoveredList. It governs how you may use the Service and the data delivered through it, including digests, CSV files, exports, dashboard content, scores, classifications and suggested outreach text (“Data”). Capitalized terms not defined here have the meanings in the Terms.
2. License grant
During an active subscription, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Data for your own internal business purposes, by the number of authorized users (seats) on your plan, for the states you subscribe to. On Agency plans, “internal” means the subscribing agency and its producers and staff working on its behalf.
3. Permitted uses
- Identifying and prioritizing businesses to offer insurance and related risk-management products and services;
- Making individual, relevant, lawful business-to-business introductions by email, mail, phone or in person;
- Importing Data into your own CRM or agency-management system for your internal prospecting and record-keeping;
- Internal market analysis and planning.
4. Prohibited uses
You may not, and may not allow anyone else to:
- Resell or redistribute the Data, in whole or in part, or provide it to anyone outside your organization, including by publishing it, sharing logins, selling or renting lists, or providing it to lead brokers, list compilers or data aggregators;
- Use the Data to build, train, benchmark or enrich a product or dataset that competes with the Service;
- Scrape, crawl or bulk-download the Service by automated means other than the exports and integrations we provide;
- Use the Data as a “consumer report” or for any purpose covered by the Fair Credit Reporting Act or similar laws, including determining any individual's eligibility for credit, insurance underwriting of individuals, employment, housing or government benefits. We are not a consumer reporting agency;
- Use the Data to compile profiles of individuals or to contact any person about personal, family or household matters;
- Harass, threaten, stalk, discriminate against or defraud anyone, or send misleading or deceptive communications, including messages implying government affiliation or that a policy is legally required when it isn't;
- Send bulk unsolicited email from shared mail lists or use the Data with automated dialers, prerecorded or artificial-voice calls, or text-message campaigns that require prior consent you don't have;
- Remove or obscure any required attribution or disclaimer; or
- Use the Data in violation of any law, regulation, carrier requirement or third-party right.
5. Outreach compliance requirements
You are solely responsible for complying with all laws that apply to your outreach. At a minimum:
- Email (CAN-SPAM Act): use accurate “From,” “Reply-To” and routing information; use subject lines that are not misleading; identify commercial messages as advertisements where required; include your valid physical postal address; include a clear way to opt out; honor opt-outs within 10 business days and never sell or transfer opted-out addresses.
- Phone and text (TCPA, Telemarketing Sales Rule, Do-Not-Call): do not use autodialers or prerecorded/artificial voices to call or text mobile numbers without the required prior consent; scrub calls against the National Do Not Call Registry and applicable state lists unless an exemption clearly applies; follow calling-time restrictions and state telemarketing registration rules; maintain an internal do-not-call list.
- Insurance regulation: hold all required licenses and appointments for the lines and states you solicit, and follow state rules on advertising, solicitation and rebating.
- Opt-outs and do-not-contact: if a business or person asks not to be contacted, stop all contact and mark the lead “Do not contact” in the Service (or your own systems).
Suggested outreach text in the Service is a starting point only. Review and edit it, and make sure every message you send complies with the rules above.
6. Corrections and suppression
We may suppress or correct records, for example in response to a privacy request, a data-source correction or a legal requirement. If we notify you that a record has been suppressed, you must delete it from any copies of the Data you hold within 10 business days, unless you have independently established a business relationship with that business.
7. Retention after your subscription ends
When your subscription ends, your license to use the Data for new outreach ends. You must delete Data you exported from the Service within 30 days, except records of businesses with which you have already communicated or established a relationship, and copies you are legally required to keep. Those may be retained in your CRM and used for that existing relationship.
8. Google Maps content
Website and phone information returned by optional lookups is Google Maps content. It is displayed live for your individual viewing, is not stored by us and is not included in exports. You may not copy, cache, bulk-extract or redistribute it, and your use is subject to the Google Maps/Google Earth Additional Terms of Service.
9. Acceptable use of the Service
- Do not probe, scan or test the security of the Service, or attempt to bypass access controls, plan limits or usage caps.
- Do not reverse engineer, decompile or copy the Service, except as permitted by law.
- Do not upload malicious code or interfere with the Service or other users.
- Do not use the Service to send messages or content that is unlawful, infringing or deceptive.
10. State attribution
Data derived from state sources is subject to the notices on our Data sources page, including the State of Colorado disclaimer. If you display Data outside the Service (for example internal reports), keep those notices with it.
11. Enforcement
We may monitor use for compliance with this License (for example, unusual export volumes). If we believe you have violated it, we may suspend or terminate access without refund, require deletion of Data and pursue other remedies, including injunctive relief. Report suspected misuse to .
